Crystal Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Crystal website and any other Crystal service that links to these Terms (together, the “Services”). Please read them before using the Services.
The Services currently consist of the public Crystal website and launch waitlist. If we introduce accounts, software, paid plans, or other product features, we may update these Terms or provide additional terms before those features become available.
1. Who provides the Services
The Services are jointly provided by Kamil Moskała and Filip Wnęk. Together, they are referred to as “Crystal,” “we,” “us,” or the “Providers.” Crystal is not yet operated by an incorporated company.

2. Agreement and scope
By accessing or using a Service, you agree to the version of these Terms presented or linked when you use it. If you do not agree, do not use the Service.
Additional terms may apply to a particular feature, plan, beta, or integration. We will identify them before they apply. If additional terms conflict with these Terms, the additional terms control for the relevant feature to the extent of the conflict.
Our Privacy Policy explains how we handle personal data. It is a notice and is not treated as consent to unrelated processing.
3. Services currently available
The website provides information about Crystal, a product in development. Product descriptions, designs, expected features, launch timing, availability, and pricing may change.
The waitlist is a free electronic service that lets you register interest in Crystal and request a launch or access communication. Joining the waitlist does not:
- create an account, purchase, paid subscription, or software licence;
- guarantee access, priority, availability, timing, features, or pricing; or
- require you to join a separate newsletter.
If optional product news is offered, you may choose it separately and withdraw that choice without losing your waitlist place.
4. Formation and termination of the waitlist service
The agreement for the waitlist service is formed when you submit a valid email address, accept the Terms made available with the form, and the website confirms that your request was accepted.
The agreement continues while we manage your waitlist request. You may end it at any time by using an available unsubscribe method or emailing support@crystal.design. We may end the waitlist or remove an entry where reasonably necessary, including when the address is invalid, the request is abusive, or Crystal is no longer being developed. Ending the service does not affect rights or obligations that arose earlier or any limited records we lawfully retain.
5. Eligibility and accurate information
You must be at least 16 years old to use the Services. By joining the waitlist, you confirm that you meet this requirement and that you are authorised to use the email address you provide.
Information you submit must be accurate and must not impersonate another person. Do not submit another person's contact details without their authorisation.
6. Technical requirements
To use the website and waitlist, you need an internet-connected device, a current web browser supporting commonly used web standards, and access to the email account you submit. Your internet or communications provider may charge you for access.
We do not guarantee that every device, browser, or configuration will be compatible or that the Services will always be available without interruption or error.
7. Acceptable use
You may use the Services only for their intended and lawful purposes. You must not:
- violate applicable law or another person's rights;
- submit unlawful content or another person's information without authorisation;
- interfere with, disrupt, overload, or circumvent the Services or their security;
- introduce malicious code or attempt unauthorised access;
- use automated means to create abusive or excessive requests; or
- misrepresent your identity or affiliation with Crystal.
We may restrict or suspend access where reasonably necessary to protect the Services, other people, or our legal rights.
8. Crystal content and intellectual property
The Crystal name, visual identity, website design, software, and original content are protected by intellectual-property laws. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable permission to access and use the Services for their intended purpose.
Except where applicable law permits it, you may not copy, modify, distribute, sell, license, reverse engineer, or commercially exploit the Services or Crystal content without our permission. Third-party names, marks, and content remain the property of their respective owners.
These Terms do not address ownership or licensing of content that users may later create or upload to Crystal. Appropriate terms will be provided before any such feature becomes available.
9. Third-party services and links
The Services may rely on or link to services operated by third parties. Their own terms and privacy notices may apply to your direct use of those services. We are not responsible for unrelated third-party websites, but this does not limit responsibilities that applicable law places on us when we select providers to process data on our behalf.
10. Changes and availability of the Services
We may maintain, modify, suspend, or discontinue all or part of the Services. We may also change information about a product that has not yet launched. Where a change materially affects an ongoing service or a right you have, we will provide notice where required by law.
We are not responsible for interruptions caused by maintenance, security events, third-party infrastructure, internet failures, or circumstances outside our reasonable control. This does not exclude responsibility that cannot lawfully be excluded.
11. Disclaimers and liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits mandatory rights available to consumers.
To the extent permitted by law, pre-launch information is provided for general informational purposes and may change. The current website and waitlist are provided without a promise that Crystal will launch or that any person will receive access.
We are not liable for loss caused solely by events outside our reasonable control or by your use of the Services contrary to these Terms. This section does not limit our obligations concerning personal data or liability for intentional wrongdoing, gross negligence, death, personal injury, or any other matter where a limitation is prohibited.
12. Complaints
You may submit a complaint about the Services to support@crystal.design. Describe the issue and provide the information reasonably needed for us to investigate it. We will respond by email within the time required by applicable law.
This complaints process does not limit your right to contact a court, regulator, consumer-protection authority, or another competent dispute-resolution body.
13. Governing law and disputes
These Terms are governed by Polish law. This choice does not deprive consumers of mandatory protections available under the law of their country or state of residence.
Any dispute will be handled by a court or other dispute-resolution body with jurisdiction under applicable law. These Terms do not require a consumer to bring a claim only in Poland where applicable law gives the consumer another forum.
14. Changes to these Terms
We may update these Terms to reflect changes to the Services, our legal obligations, or the way Crystal operates. The updated version will show a new effective date.
Changes apply prospectively. If a material change affects an ongoing service, we will provide reasonable additional notice where required. If you do not agree to an updated version, you may stop using the affected Service and leave the waitlist.
15. General terms
If a provision of these Terms is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
We may transfer these Terms as part of a genuine reorganisation or transfer of Crystal, subject to applicable law and without reducing mandatory consumer rights. You may not transfer your rights or obligations under these Terms without our consent where the transfer would affect the Services or another person.
These Terms and any applicable additional terms form the agreement concerning the Services they cover. They do not create rights for third parties unless applicable law provides otherwise.
